Steps in the bankruptcy process:

1.  Consultation appointment with attorney.  At this appointment we will assess your situation and assist you in determining whether or not bankrutpcy is the right choice for your situation.  If you choose to file a bankruptcy we will provide you with the worksheet which we will need you to take home and complete, along with a list of documents which we will need you to provide.

2.  Once you have completed the worksheets and compiled the list of documents, you will then set up an a petition preparation appointment with a member of the staff.  At that appointment you will also receive instructions on how to complete your first session of credit counseling.

3.  Once the petition is reviewed by the attorney and you have completed your credit counseling, you will then set up an appointment to come in to review and sign the petition.  After the petition is signed, it is then electronically filed with the court.  You will then be provided with information on how to complete your second session of credit counseling.  WE ASK THAT YOU DO NOT BRING CHILDREN TO THE SIGNING APPOINTMENT.  It can take as long as two hours (even longer in complicated cases).  Children often become restless, making the process longer for everyone.

4.  Once the petition has been electronically filed with the court, you will have protection from your creditors.

5.  Within a week of the filing of the petition, you will receive a notice to attend your Meeting of Creditors.  You must attend this meeting. 

What happens from here will depend on which chapter of bankruptcy you have filed.  We will explain the process to you from here.
